Terms and conditions

Please read the following important terms and conditions before you buy anything on our website.
In this contract:
• ‘We’, ‘us’ or ‘our’ means The Sia Garden LLC, a single owner limited liability company registered in Dubai, with commercial license number 897612; and
• ‘You’ or ‘your’ means the person using our site to buy goods (including but not limited to flowers and plants) from us.

1 Introduction
1.1 If you buy goods on our site you agree to be legally bound by this contract.
1.2 When buying any goods you also agree to be legally bound by:
1.2.1 our general website terms and conditions;
1.2.2 our privacy policy;
1.2.3 any other terms and conditions as may be published on our website from time to time
All of the above documents form part of this contract.

2 Your privacy and personal information
2.1 Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us if you have a query or complaint about the use of your personal information.
2.2 Our Privacy Policy is available at https://www.thesiagarden.com.

3 Ordering goods from us
3.1 Below, we set out how a legally binding contract between you and us is made.
3.2 You place an order on the site by completing the order form. Please read and check your order carefully before submitting it (as errors cannot be rectified after submission).
3.2.1 When you place your order at the end of the online checkout process (e.g. when you click on the “Accept Terms & Conditions” button), we will charge your card if you are paying by electronic means and send you an email confirming that we accept your order (“Confirmation Email”). At this point:
3.2.2 a legally binding contract will be in place between you and us; and
3.2.3 we will dispatch the goods to you, subject to the conditions in clause 6.4.

3.2.4 We may contact you to say that we do not accept your order. This is typically for the following reasons:
(a) the goods are unavailable;
(b) we cannot authorise your payment;
(c) you are not allowed to buy the goods from us (if you are under age for example); or
(d) we are not allowed to sell the goods to you;
(e) there has been a mistake on the pricing or description of the goods.

3.3 If you are under the age of 18 you may not buy any goods from the site, unless your legal guardian authorises this contract.

4 Cancellation of this contract
4.1 You have the right to cancel this contract, by telephoning us on +971 564129569 or sending us an e-mail to infogarden@thesiagarden.com within 1 hour of receiving your Confirmation Email.
4.2 If you cancel this contract pursuant to clause 4.1, you will receive a credit note which can be used against future purchases, which must be used within 3 months (“Store Credit”). You will receive Store Credit which is equivalent to all payments received from you, including the costs of delivery.
4.3 You acknowledge that we reserve the right to limit quantities, reject, correct, cancel or refuse orders, and to terminate accounts, solely at our discretion. We will notify you by e-mail in such case. We will not be obliged to offer any additional compensation for disappointment suffered.

5 Exchange and Store Credit Policy
5.1 You are required to check your goods upon delivery. You will be entitled to exchange your item for the same item or other goods of equivalent value/ receive Store Credit only if:
5.1.1 The wrong goods have been delivered to you; or
5.1.2 There is a defect in the goods.
In which case you can immediately return the erroneous/defective goods to the delivery person at the time of delivery provided that the goods are in their original condition (and are not tampered with), and remain sealed in their original packaging.
5.2 We may make a deduction from the reimbursement (in the form of Store Credit) for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will provide substitute goods/ issue Store Credit (as determined by you) without undue delay and not later than 30 days after the day we received back from you any goods supplied (in such case only the price of the goods will be taken into account – delivery and handling fees cannot be reimbursed).
5.3 We do not offer refunds under any circumstances.

6 Delivery
6.1 Delivery is available only in the Emirate of Dubai and we will give you a call on the telephone number provided on the order form to schedule delivery to the address specified in your order form at an agreed time slot.
6.2 Delivery is free of charge for all orders above the value of AED 180.
6.3 You must ensure that you are available to collect the goods at the delivery time that you have selected. If nobody is available to take delivery, please contact us using the contact details at the top of this page, at least 24 hours in advance of your chosen delivery time to reschedule delivery. Otherwise, if our delivery vehicle arrives with your goods and no one is available to accept delivery, you will be liable to pay the full price plus delivery charges for any goods (especially in the case of perishable products including but not limited to fresh flowers and plants).
If you are not available for any reason when our delivery vehicle arrives, and our delivery vehicle needs to return, you will also be liable to pay additional delivery charges for any subsequent deliveries for the same goods.
6.4 If something happens which:
6.4.1 is outside of our control; and
6.4.2 affects the estimated date of delivery;
we will let you have a revised estimated date for delivery of the goods.
6.5 Delivery of the goods will take place when we deliver them to the address that you gave to us and someone places their name, signature and date confirming acceptance on our goods delivered note.
6.6 You are responsible for the goods when delivery has taken place. In other words, the risk in the goods (and all liability) passes to you when you or someone you authorise takes possession of the goods.
6.7 You are responsible for providing a suitable parking bay for our delivery vehicle to be safely parked at the delivery location which you select – if a gate pass is required, you shall arrange for the same in advance of the delivery time.

7 Payment
7.1 We accept payment by credit card/ debit card and we also accept cash on delivery.
7.2 We will do all that we reasonably can to ensure that all of the information you give us when paying for the goods is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, any failure by us to comply with this contract or our Privacy Policy or breach by us of our duties under applicable laws we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.
7.3 Your credit card or debit card will only be charged at the time you accept our terms and conditions on our website.
7.4 All payments by credit card or debit card need to be authorised by the relevant card issuer. We may also need to use extra security steps via your authorised card provider.
7.5 If your payment is not received by us and you have already received the goods, you must pay for such goods within 7 days. Otherwise, we may collect the goods from you at your expense. We will try to contact you to let you know if we intend to do this.
7.3 The price of the goods:
7.3.1 is in United Arab Emirates Dirhams;
7.3.2 includes VAT at the applicable rate; and
7.3.3 does not include the cost of delivering the goods for orders less than AED 180 (which charge will vary depending on your location).

8 Nature of the goods
8.1 The packaging of the goods may be different from that shown on the site.
8.2 While we try to make sure that:
8.2.1 all weights, sizes and measurements set out on the site are as accurate as possible, there may be small variations, we may in our sole discretion from time to time vary the nature of the goods from that advertised without notice to you, so long as these variations are not material alterations (especially in the case of plants which are living things you appreciate that there are inevitably slight variations in size, shape and colour between different specimens and there may be some slight natural variations in colour and size, flowering plants may not be in bloom at the time of delivery); and
8.2.2 the colours of our goods are displayed accurately on the site, the actual colours that you see on your computer may vary depending on the monitor that you use.
8.3 We ask that you plant your plants according to our simple growing instructions which are mentioned on our website. If you require any additional support please get in touch with us.
8.4 We are also not able to guarantee that a plant will produce flowers or fruit at a particular time. That’s because this is largely determined by external factors beyond our control, such as the age of a plant, or the availability of water, light and nutrients.
8.5 Some of our flowers/plants may be harmful or poisonous to humans and animals and should be handled with care. Please do not eat any leaves, berries or flowers on our plants unless they are sold as items which may be consumed.
8.6 If you discover that any plant which you purchased from our site is afflicted by pests within 48 hours of delivery, please let us know and we will replace it with a suitable alternative.
8.7 If we cannot supply certain goods we may need to substitute them with alternative goods of equal standard and value. In this case:
8.7.1 we will let you know if we intend to do this but this may not always be possible; and
8.7.2 you can refuse to accept such substitutes; in which case we will offer you Store Credit.

9 End of the contract
If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.

10 Limit on our responsibility to you
10.1 We reserve the right to make changes to product information and prices without prior notice.
10.2 Except for any legal responsibility that we cannot exclude under applicable laws, we are not liable to you for:
10.2.1 losses that:
(a) are not foreseeable to you and us when the contract was formed;
(b) indirect, incidental or consequential damages suffered by you due to any matter arising out of this contract; or
(c) that were not caused by any breach on our part;
10.2.2 business losses; and
10.2.3 losses to non-consumers.
10.3 We will not be liable to compensate you in case we are unable to deliver or fail to comply with our obligations under this contract if such delay or failure arises from any cause due to any reasons beyond our control, including but not limited to civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster, or failure of public or private telecommunications networks unavailability of materials or impossibility of the use of railways, metro lines, shipping, aircraft, motor transport or other means of public or private transport.

11 Disputes
11.1 We will try to resolve any disputes with you quickly and efficiently.
11.2 If you are unhappy with:
11.2.1 the goods;
11.2.2 our service to you; or
11.2.3 any other matter;
please contact us as soon as possible on [insert contact details].
11.3 Any dispute which cannot be resolved amicably between us shall be subject to the exclusive jurisdiction of the Dubai Courts.
11.4 The laws of United Arab Emirates as applicable in the Emirate of Dubai will apply to this contract.
